According to the statutory framework of the Workers' Compensation Act, attorney's fees are regulated by statute. Pursuant to O.C.G.A. Sec. 34-9-108, attorney's fees are limited to no more than 25% in a Workers' Compensation case. It is also important to note that in a settlement, attorney's fees may not be taken against amounts specifically designated for the Employee/Claimant's past or future medical care.
