What Does Temporary Partial Disability Cover?
If you’ve been injured but you are still working on light duty, and you are losing wages due to time missed from work to go to your WC doctor, physical therapy, or elsewhere, then your employer or its Workers’ Compensation insurer should be paying you for two-thirds of the wages you are losing for the time you miss from work for those appointments. TPD benefits cover employees who are forced to miss work hours for medical treatment stemming from a workplace injury. TPD benefits also cover employees who are able to return to work at a lesser rate of pay than they earned before their accident, if the lesser pay rate is due to their injuries.
You are entitled to receive 2/3 of weekly wages lost due to:
- WC doctor’s appointments
- physical therapy sessions
- Trips to see any other healthcare provider
- Wages lost due to working on light duty and making less money after the injury
The amount you should receive is determined by comparing your average weekly wages over the 13 weeks prior to the WC injury with what you make during any week in which you have a healthcare visit due to the work injury. If you have less wages that week than you did during the 13 weeks before the injury, you are entitled to receive TPD benefits. Any injuries occurring after July 1st, 2015 are subject to a weekly TPD compensation cap of $367 per week, though injuries occurring before this time may have a lower cap. An injured employee can receive TPD benefits for up to 350 weeks after being injured.
